Legal Question in Consumer Law in Wisconsin

vehicle warranty

I purchased a warranty when buying a vehicle six months ago. I now have problems with the vehicle and contacted dealership. They told me that the warranty was never purchased and an employee pocketed the money. They claim to have a pending case against him. They said the only thing they will do is refund the price paid for warranty, which is less than the needed repair. Is my only option to accept a refund?

No you have a right to the warranty coverage under the law of agency.

The agent had apparent authority to bind the dealer and I presume you received some documentation to that effect.

You need to sue the dealer if they don't make good on warranty coverage.

(This is like when an insurance agent tells you there's coverage of a policy but forgets to send it in to the company).
