I would recommend that you speak with an experienced bankruptcy attorney as soon as possible. Once you receive a bankruptcy case number from the federal court, notification of your clerk of circuit court of a bankruptcy filing under any chapter generally stops garnishments, unless they involve taxes, child support, damages from a drunk driving accident and a few other very specific items. Past due rent should be no problem in terms of getting the garnishment stopped as soon as you get your bankruptcy case number and a debt of that nature would generally be dischargeable. My comments in this online forum are not intended as specific legal advice for you unless you subsequently retain me and revisit this issue.
