Legal Question in Credit and Debt Law in Wisconsin
Looking to see how I can avoid going to court for a reposition if caught up on my payments before the court date
1 Answer from Attorneys
That will be up to your bank, since they can still technically repo the vehicle, even if you catch up the payments. A lawyer negotiating with them might be able to make sure that this doesn't happen, but, if they do take it, filing a viable chapter 13 plan can get it back. Chapter 13 can also allow you to pay off the entire debt over up to five years, and potentially reduce the amount to the value of the vehicle if the loan was had been in effect for a substantial time before you filed.
