Legal Question in Credit and Debt Law in Wisconsin
can a bank seize my car without going to court first
1 Answer from Attorneys
Absolutely yes, lenders can now use self-help repossession in WI without going to court as long as the loan documents permit it and they first send out all of the required warnings (and can accomplish the vehicle pickup without a breach of the peace). The good news, however, is that a chapter 13 bankruptcy can get your car back, so long as it is filed before the bank resells the car and you resume payments through an approved chapter 13 plan. You will also be required to prove that you have purchased your own auto insurance, including comprehensive coverage for damage to teh vehicle. You therefore owe it to yourself to consult with an experienced bankruptcy lawyer, assuming that you car is worth the expense of a bankruptcy filing. These comments are not intended as legal advice but are instead offered only for public educational purposes.
