Legal Question in Credit and Debt Law in Wisconsin

Collection agency harassment

I have a collection agency calling me for months now, in regards to someone else. I've asked every time for them to take my number of their list, they have not. The agent calling and the supervisor WILL NOT tell me the collection agency's name so I can contact their HQ. What can I do legaly to have them traced, and then sue them for harassment as this has been going on for many months now and my family an I are tired of their calls. I've done reverse phone number looks up off the call ID, but it does not list any information on it. Should I contact a lawyer, the police, what should I do, I'm lost and need help. I tell them every time that there are laws aginst contacting me after asking them to remove my number, but they continue to do so, I'm tired of it, and I'm willing to go to court over this for damages. Collection agency phone number is a Wisconsin phone number 414 434 4465 which comes up Milwakee WI on my ID.

Collection Victimization for Someone Else's Debt

Any time someone is trying to stop collection activity on a disputed debt (and demanding court if the creditor wants to push the issue), they should put the dispute in writing and send it certified mail, which should yield a live person who can be sued if the collection activity does not stop. You can also make a police complaint if the calls are truly harassment and not legitimate collection activity, since telephone harassment is a misdemeanor in WI. Originating creditors who irresponsibly and wrongfully place a debt for collection can also be sued, although I would try to contact them first. The originating creditor can "turn off" the collection process, so your efforts might be more effectively directed against them.

Re: Collection agency harassment

You can try filing a complaint with your telephone company, the Wisconsin consumer protection agency (Department of Agriculture), the Federal Trade Commission and/or contact a private attorney that specializes in FDCPA violations. I am aware of a firm that handles these cases in Madison or you can look for an attorney in your own area.
