Legal Question in Credit and Debt Law in Wisconsin

Deceased Spouses Credit Card

My spouse passed away six months ago and had a credit card in his name only. I have been making payments regularly and abundantly to get this taken care of. Now the credit card company has referred this for collection because I am not a co-signer on the card, he is deceased and they want the full amount of $1770.00 NOW. My husband did not have a will, and there is no 'estate'. I don't understand why I cannot continue to make payments; my income is all I have and I guess I wonder if I am even responsible for this debt.

Re: Deceased Spouses Credit Card

Hello,

I do not have all the facts, but from what you said, it seems doubtful that you owe anything on that card. If only your husband was on it, you are not liable because the card company did not contract with you. Of course, if you send them money, they can take it, and that is what has been going on apparently. If you stop paying, there may be nothing they can do.

Best wishes.
