Legal Question in Credit and Debt Law in Wisconsin
I have a distant uncle whom I have not been in contact with for years. He recently advised me there has been a collection agency harassing him for me. They were told he was on a do not call list and not to call again. The calls continued until he threatened with prosecution. Also, they lied to him and told him I had given them his number as a contact number! This has caused a rift between us and has made it difficult to move past. My uncle thinks I actually did this!

The entire country has experienced a huge increase in telephone scams recently where the callers pose as bill collectors, law enforcement officers, bankers, etc. with the goal of intimidating the citizen answering the phone into paying them money or gets them to furnish information for identity theft. The problem has become so severe that I would recommend assuming that all such "cold calls" are scams until proven otherwise. Legitimate collectors will usually begin the collection process with some sort of letter. This allows you to verify that their agency really exists when they follow up with a phone call. You should furnish your uncle with information about such scams in order to show him that everyone is getting these calls. Your uncle (and everyone else) should also report all such problems to law enforcement. If your uncle really does have problems with bill collectors, he also owes it to himself to have a free consultation with a bankruptcy attorney. My comments here are not legal advice, nor do they create an attorney client relationship between us. However, you always more than welcome to contact my office in Racine to discuss any additional questions which you may have or to set up a free consultation.
