Legal Question in Credit and Debt Law in Wisconsin
After filing Chapter 128.21 for a utility bill, the creditor (utility company) credited my account which significantly reduced the total amount due. What claim do I need to submit in order to have my amoritized debt payment reflect this.

Either in a bankruptcy or in a WI chapter 128 voluntary receivership, amended claims are possible, and they can often be filed by the debtor as well as by the creditor. If the utility company does not file an amended claim, you should therefore file one on their behalf. However, I do not have enough information to address your specific question and you should therefore consult with an experienced bankruptcy attorney about your case. You may also be eligible for a complete discharge (legal forgiveness) of your debt in chapter 7 rather than having to pay it back in chapter 128 (whch does not provide any discharge of debt). My comments in the public web forum are not legal advice, but are instead provided solely for purposes of public education. No attorney client relationship is created because I have responded to your question. However, you are welcome to contact my office in Racine, WI, to make necessary arrangements to retain me.
