Student Loans and Bankruptcy--Hardship Discharge
Bankruptcy relief from student loans is very limited. They are no longer dischargeable (there may be an exception for certain very old loans), but one can try to pay them off as a part of a chapter 13 plan over five years. However, the payment required in order to accomplish this might be higher than the payments normally required on a large loan. There can sometimes be a "hardship discharge" for very good reasons such as a terminal illness, disability, exceptional expenses relating to a handicapped child, etc. You need to discuss this with your attorney as I do not have any of the specifics of your case and could not advise you in any event without representing you.
