Legal Question in Credit and Debt Law in Wisconsin

My mother recently passed away and had several credit cards and department store cards in her name alone. We live in Wisconsin and understand that this is a community property state. Is my father responsible for payments to these accounts? Have insurance and payment on medical bills, there will not be any funds available for payments.

While your surviving father would normally be liable for your deceased mother's credit cards, even if he had not used them, under Wisconsn's marital property law, he may have many defenses available to the bank's collection lawsuit. He should therefore immediately consult with an experienced bankruptcy lawyer.
