A simple bankruptcy should prevent creditors from pursuing anyone who is eligible for a discharge, which includes persons in nursing homes. If that person is not legally competent, the legal guardian or POA can file the bankruptcy on their behalf. However, as a practical matter, there may not be too much that creditors/bill collectors can do to an indigent person who is institutionalized. A cease and desist letter from an attorney (demanding an end to collection activities unless the creditor goes through the courts) might also solve the problem. My comments in this online forum are offered for public educational purposes only and are not legal advice, nor do they create any attorney/client relationship between us. However, I may be able to formally represent you if you contact my Racine office and make arrangements to retain me. I also represent clients throughout WI.
