Yes, it is not only legal, but if you do not defend yourself, the collector can take a judgment against you and garnishee your wages. There is no legal requirement that all cases brought to court by a collection agency be meritorious claims; parties are therefore expected to look out for their own welfare and nobody else in the system does that for them. If you have a problem with large bills in addition to this $100,, you should probably at least consult with a bankruptcy attorney, who may be able to have all of your unsecured debt discharged (forgiven) in bankruptcy. All this being said, if the collector brings a frivolous claim which has no merit and is intended only to harrass you, you may be able to make a counterclaim against him and be reimbursed for your troubles. My comments here are not legal advice, nor do they create an attorney client relationship between us. However, you are welcome to contact my office to discuss retaining me or to set up a free initial consultation at my office in Racine. I also can sometimes arrange to travel outside of Racine for initial consultations if absolutely necessary.
