Unfortunately, if you are unable to make it to most civil court dates, the other side wins automatically. However, even if you do appear, if you do not have a legally valid defense, you will still probably lose, meaning that the outcome may be the same. There are some limited poverty defenses to garnishment in WI for people whose income is extremely low. However, they may or may not be successful and are far from a sure thing. For this reason, you should have a meeting with a bankruptcy lawyer as soon as possible, since a chapter 7 will not only get rid of this particular debt, but all of your others as well, at a cost somewhere relative to $1000, plus court fees, depending upon how simple your case is. These comments are not legal advice for you specifically, but are rather offered for public educational purposes.
