Legal Question in Credit and Debt Law in Wisconsin

Small claims judgement and bankruptcy

We have just won the sm. claims suit we filed on our neighbors for 2700.00. they have left their property(an adjoining condo) and the bank is foreclosing. they are going to be getting a divorce and they live in different states. i know that the female is in the process of filing for bankruptcy but i am unaware if he is planning on it as well. what can i do to secure my judgement? will a lein on the condo that is being forclosed on suffice? what are my options? ..... i live in WI where the case was won, she lives in NM and he lives in MI

Re: Small claims judgement and bankruptcy

There should be a judgment lien automatically placed on the defendants' real estate - check with the clerk of courts for the county where it is located. You should also be able to serve both of them with court-ordered financial disclosure forms to find out what bank accounts they have and where they might be employed. That information can then be used to file a garnishment action against them. Getting the judgment was the easy part - now comes the hard part of trying to collect on it. Good luck!
