Legal Question in Credit and Debt Law in Wisconsin
I'm in the tranpsortation industry and frequently deal with customers who default on their payment terms. Would a Promissory Note "override" or extend the 18 month statute of limitations of transportation?

I am not familiar with the 18 month statute of limitations in transportation. However, if you were only dealing with WI state law and not federal law or ICC Administrative rules, a promissory note would normally carry a 20 year statute of limitations here. If you were suing on the note alone, you could therefore probably still do so up until the expiration of that period, but I would not count on this without additional research.. Without knowing more detail and having the citations, there is no way that I can intelligently advise you, and would particularly need to first research the 18 month regulation to which you are referring. My comments here are for public educational purposes only and are not legal advice specifically tailored to your specific situation. You should therefore retain a lawyer in order to meet your legal needs, or at least schedule a private consultation with one. I am not your attorney and will not be taking any action on your case.
