Obviously, if the creditor has already garnisheed your wages or refund, they can do it. However, this does not mean what they did was legal or that it did not violate your constitutional right to protect your income through the federal bankruptcy process or state exemption claims. Despite the many rights which we enjoy as citizens in the United States, a sad fact of life here is that nobody can protect those rights but you. If you choose to do nothing, these rights are useless to you and will be lost through the legal doctrine of "waiver," resulting in loss of your income and assets. If you want to protect yourself, you therefore need to immediately schedule a free initial consultation with an experienced bankruptcy lawyer. For not much more than $1,000, you should be able to discharge most if not all of your unsecured debts without losing any assets, with the exception of student loans, fines, income taxes less than three years old, and a few other items. Ambulance bills, just like all other medical obligations, are completely dischargeable for anyone eligible for bankruptcy relief unless you were ordered to pay them as a part of a child support or other family court order.
