Legal Question in Criminal Law in Wisconsin

4 years ago, I was charged with possession of marijuana in Wisconsin. The Wisconsin court system website says that it was NOT a criminal offense. On an application in Colorado, I have to list any felonies or misdemeanors I've been convicted of. Do I have to list the possession charge?

Sometimes, charges involving simple possession of tiny quantities of THC in Wisconsin are reduced to ordinance violations for persons without any prior record. Ordinances are defined as forfeiture actions, often featuring fines and driver's license loss as the only punishments which are available to the judge. These are normally not considered either felony or misdemeanor criminal charges or convictions in WI. Whether this is also true in Colorado is beyond my area of legal expertise; I would recommend instead that you consult with an experienced employment law attorney in Colorado. Whoever you consult with, make sure that you also show them a copy of the employment application which are you are competing. They will need to see exactly how the question is framed before advising you how far you can go in answering it truthfully while incriminating yourself as little as possible. My comments in the online web forum and intended for public education only and are not legal advice for you. You should therefore contact your own attorney before acting upon any suggestions made here. You are also welcome to contact my Racine office to set up a free initial consultation with me about my possibly accepting your case.
