Legal Question in Criminal Law in Wisconsin

about 5 or 6 years ago my son was accused, questioned and had to go to intake for sexual abuse charge for his half sister. The attorney we had was good and everything was dismissed. now the same family is accusing him of 4 counts of sexual assault with another half sister that happened 3 years ago and my son is now 18. The attorney that we had is now a judge. Can we at least talk to that judge for advice since he was the lawyer before?

Circuit court judges are usually prohibited from practicing law in any county where they serve as a standing judge, so you therefore probably need to hire a new attorney. I do not believe, however, that there would be anything improper about asking your former lawyer or members of his firm for a referral, or to request representation from members of his former firm. Your former attorney (now a judge) would not be able to serve as judge on your son's case and would need to recuse himself. I am not yet your attorney and will not be taking any action on your case, but you are still welcome to contact me during business hours at my in Racine if you still have more questions.
