Legal Question in Criminal Law in Wisconsin

alternative to revocation

I was convicted of felony possession of THC and OWI 1st on 03/12/07 in Jackson 'County Wisconsin. After eleven months of sobriety I relapsed and was sent to jail on a PO hold. I was served revocation papers and ended up agreeing to an ATR of 6 months in county jail or an appropriate treatment program. I sat 2 months in county waiting for a spot in treatment. I went through treatment with good reviews from my counselors. I was then sent to a transitional living program which is supposed to be 6-12 weeks long. I am supposed to follow the rules and save $800 before I can be released. Well I am following all the rules but I am having trouble obtaining employment. I keep getting temporary work and have been out of work now for one week. My liason PO for the program is talking about sending me to jail on bad terms for non completion of the program. I have been putting in 15-25 applications a day and trying to get work. I am not allowed a vehicle in the program and it is holding me back. If I do get sent to jail what are my consequences? Can I get revoked? I am following all rules and doing everything I can to get a job. What should I expect? I get no solid answer from my PO. Should I be worried?

Re: alternative to revocation

Whenever the DOC and revocation is involved there is always cause to be worried. However, if you are truly doing everything you can, then that is all you can do. Continue looking for employment and make sure you document all of your efforts and your compliance.

As much as it may pain you to do so, be as nice and pleasant as possible with the agent, and explain your situation without getting upset. Explain that you are trying everything you can to get a job.

If they still bring revocation proceedings then make sure your Attorney makes every effort to point out the things you have done to be compliant.

Good luck to you, supervision is a lot more difficult then many realize, but if you truly make every effort to adhere to your supervision the ALJ should realize that and not revoke you.

Good Luck.
