i was arrested for theft in 2006 and never charged
how long do they have to charge me and how long do i have to sue them for emotional distress

They cannot be sued for emotional distress and the statute of limitations depends on the level of the charge. While a misemeanor theft may have a statute of limitations of three years, a felony could be considerably longer.
