Legal Question in Criminal Law in Wisconsin
my brother has been sentenced to 3 years in prison for battery in Wisconsin-does he have any say what prison he goes to? Lawyer told him he would be going to a medium security facilty
1 Answer from Attorneys
I am very sorry to hear about your brother's problems. Normally, incoming prisoners are classified by the WI Dept. of Corrections following an extended stay at their Dodge "reception center" in Waupun. From there, they are assigned to an appropriate institution based upon their determined security risk. I do not know of any way that an attorney, or even a judge, can guarantee what level of security institution any inmate will go to. Of course, any professional can attempt to forecast this based upon the offender characteristics they are aware, but a great deal more information might become available to the Department after observing the person in custody after several months in the reception center. All this being said, an average inmate might go to an average institution. That might very well turn out to be a "medium security" one. Instead, you should retain a lawyer in order to meet your legal needs since I will be taking no action on your case.
