1 Answer from Attorneys
Identity Theft; Victim Dropping Charges
Your situation is a very common one, particularly between relatives (i.e., parents stealing identities of their children and vice versa, spouses, etc.). However, victims do not have a right to unilaterally "drop" charges once they have formally gone to court. Rather, the State of WI controls the charges through the prosecuting DA. Cases are often brought to trial with uncooperative victims, although obtaining convictions in such situations may be difficult. You therefore need to retain your own attorney as soon as possible--I cannot represent you via the online form and my comments are intended as general comments only; not legal advice.
