Legal Question in Criminal Law in Wisconsin

I am being charged with identity theft and forgery. I used someone else's checks (which i had permission to use) at a grocery store and wrote it for 20$ over the amount. How should i prove that i had permission to use the checks? and if i prove that i had permission, is there anyway i can still get charged with anything?

Tell your lawyer to subpoena the owners of the checking account to testify at your jury trial, and try have your private investigator get an affidavit from them ahead of time. However, if they told the police earlier that you did not have permission to use the checks, they may be hesitant to change their story, since they could be charged with obstructing an officer. You should go over all of this in the privacy of a law office, rather than on a public internet forum which could easily be traced to you by law enforcement and potentially used against you in court.
