Legal Question in Criminal Law in Wisconsin
My cousins' husband is being held as a murder suspect in Wisconsin. He has neither been tried nor convicted at this point in time. Is it legal for the family of the victim to sue him and his wife for their assets at this point in time? I ask because they were just served papers notifying them of the suit on Friday.

Yes. He can be sued regardless of whether he is ever put on trial. Even if he is put on trial, he can be sued regardless of whether he is acquitted or convicted. (Remember O.J. Simpson, who was acquitted of murder but who was later found civilly liable for the same deaths.) The victim's family does not have to await the outcome of the criminal case before it can sue the suspect.
