Can someone be tried twice for the same crime?

My brother was sentenced to prison 8 years ago for a sexual crime involving an under 18 teenage girl. He served 8+ years and was to be released on Tues. April 25th. He was then moved from the prison to the county jail in which he was sentenced. They next sentenced him to 45 days in a mental institution for observation. At the end of the 45 days, he will then be tried again under Wisconsin's new sexual predator law. He could end up with 40 more years! I think this is ludicrous when he already did his time and that law wasn't in effect when he committed the crime! There are murderers that get off easier then that. Thank you.

Yes, the new sexual predator law is a very

scary thing. It has the potential for a life

sentence on the installment plan. The only

saving grace is that he has the right to a

trial by jury on whether he is indeed a sexual

predator. Some defendants have been winning

these trials lately.
