my fiance and i were picking up scraps on railroad tracks there were no signs posted of any kind police arrived tried to say we were lying about picking scraps from the ground said we were stealing from off the train but called person that called and reported inciendent confirmed we were not on train police officer called us lierers and said we were terspassing but no signs were posted and gave each of us tickets for 300.dollars each

Defense of Trespassing Tickets

I cannot advise you in this matter unless I represent you. I would recommend that you retain an attorney to fight any charge which you dispute. However, technically speaking, in WI, the posting of signs prohibiting trespassing is no longer required, although many landowners still post them as an additional deterrent. Persons going on private property therefore have the burden of making sure that they have permission to do so and can therfore be prosecuted, even without signs, if the landowner wishes to push the matter.
