Legal Question in Criminal Law in Wisconsin
expungement
How can I get an old case expunged and do it myself?
1 Answer from Attorneys
Expungement of Criminal Convictions and Pardons
Although I cannot give you legal advice unless I am retained as your attorney, as a general matter, expungement of old criminal convictions in WI has become extremely difficult recently due to new case law saying that judges have only limited power to do this. Unless you were under 21 at the time or have enterred into some sort of deferred prosecution agreement, it is now nearly impossible. You may be better off petitioning the Governor for a pardon, which would have the same effect as expungement. You should retain an attorney to assist you with this process, as these are also extremely hard to get. Pardons are essentially political decisions.
