what would i say to the judge on my boyfriends behalf?

Not knowing much about your boyfriend or his case, it is hard for me to suggest what you might tell a judge on his behalf in order to help him in his criminal matter. Generally speaking, however, judges are reasonable folks who apply common sense ethical principles to the criminal defendants who come before them. Anything which you could tell the judge suggesting why he should see your boyfriend is an ethical, community minded person could only help him. The judge's primary concern in a criminal cases is usually the protection of the community, i.e., how he can make sure that your boyfriend does not re-offend. While this could occur via rehabilitating your boyfriend by treating drug and alcohol problems, requiring counseling to deal with psychological problems, of psychiatric care for mental health problems, etc., the "fail safe" option to protect the community from any defendant is always by locking them up. Your goal therefore is to convince the judge that the other options outside of prison will protect the community better than incarceration. Unfortunately, for some defendants whose problems are too severe and self control too weak, jail may be the only practical treatment available to society. The outcome will often depend upon whether or not he falls within this category.
