Misdemeanor theft in WI would normally be a class A misdemeanor; punishable by up to nine months in jail and/or a ten thousand dollar fine. Without knowing more about you and about the offense, I could not begin to speculate what a judge might actually do with you if you are convicted of this. However, if you are not convicted or negotiate a plea bargain involving reduction of the charge to a noncriminal offense, these penalties would not apply to your case. Ordinance violations normally do not carry the possibility of a jail sentence unless you fail to pay your fine as agreed. You therefore need to hire an experienced criminal lawyer as soon as possible to protect your rights. My comments here are not intended as legal advice unless you subsequently retain me and revisit this issue with me at that time.
