If I get married to a convicted felon can I be held liable for his restitution?

Yes, if you do not have a valid and enforceable prenuptial agreement or other document created after marriage opting out of the WI Marital Property Act, your convicted felon husband will own half of your property since it will be what is known in WI as Marital Property. Marital property is generally subject to seizure by creditors, including crime victims or courts representing them, even if you are not obligated to them yourself. You therefore urgently need to consult with a lawyer with expertise in creditor debtor law. Bankruptcy lawyers generally have the greatest expertise in this area and many of them can also assist you with such agreements. They can also advise you how to implement them in order to protect you, which is far from automatic.
