Legal Question in Criminal Law in Wisconsin
Miranda Rights
When do you get read your miranda rights? Can they take you to jail first and then read you your rights or are they supposed to read them to you when they hand cuff you?
Also, what happens if you do not take the breathalizer test? Do is there any recourse?

Re: Miranda Rights
See my previous answer on Miranda rights.
Refusing chemical tests is a different
issue. Assuming that this was a drunk
driving arrest, refusals will lead
to automatic license revocation unless
you request a refusal hearing
within 10 days. You need a lawyer right
away. Send me a private e-mail for
more detail.
