Legal Question in Criminal Law in Wisconsin

25-year-old mentally disabled son arrested for physical abuse of child involving then 17-year-old brother, two weeks from being 18. Had another incident with same brother about 7 years ago. Agreement that he is NGI. Charges in Wisconsin, he resides in Illinois. He lived in Wisconsin at the time of the incident, but had three weeks before his lease would be effective in Illinois. Being told he can go with the NGI with Wisconsin and have to move back to Wisconsin for supervision of the conditions of release or can go with guilty and continue to live in Illinois. Possible issue with losing Section 8 vouchers because of violent crime. Suggestions?

It sounds as if the State is giving you an option for a probationary disposition. Remember, that unless it is for a felony there is a good chance your son may not be able to transfer his probation to Illinois. It is likely worth your while to hire a good attorney to help formulate a plan for services that will convince the State to agree to a deferred prosecution or other creative solution to best serve his needs.
