Legal Question in Criminal Law in Wisconsin
I was on probation and was arrested for a new charge. My probation was revoked and I spent about 5 months in jail. Sentencing is coming up for the new case and I've gotten conflicting opinions in regard to WI Statutes 973.155
Does the time I spent either waiting for my revocation hearing or serving the stayed sentence count toward ime-served on the new case?

Credit towards to new charge for the time you spent awaiting revocation on an unrelated old charge is not a sure thing. While an experienced criminal lawyer representing you on both matters could probably arrange things that way, if you received a signature bond on the new charge or posted bond and got released, you would not normally get credit for that time against the new charge. You need to discuss this with your lawyer. My answer here does not make me your lawyer, so you need to consult one of your own before acting upon this.
