Probation

I would like to go on a short vacation in another state with my family, but am still on probation for a few months as all restitution has not been paid. My P.O. will not allow me out of state - is this normally the case. I have been making regular monthly payments.

Probation officers possess nearly "God-like" powers over their probationers. The legal theory behind this is that a probationer already has "one foot in jail" due to the sentence of probation orderred by the judge. The probationer can only keep the other foot out of jail if he obeys the rules set by his P.O. That being said, however, probationers still have limited protection from arbitrary and capricious conduct by their P.O.'s. A good criminal attorney might be able to solve this problem rather easily, depending upon the reasons given by the P.O. for denying the vacation. Good luck!
