Legal Question in Criminal Law in Wisconsin

promoting prostitution and gun replica posesion

I was cought with a prostitute and a gun replica in a car. the police gave me two choises: to tell the truth about the protitute so I can go home with a $661 ticket (I was denying it). If not, he was going to give me a $10000 fine and 3 days in jail for the gun replica, I want to know if there's such a law about gun replica under driver seat. So I said the truth and he gave me a PROMOTING PROSTITUTION TICKET OF $661. I ask him if that was going to be in my criminal record, he said: NO, this is like a traffic ticket. But then he said if I get cought again with a prostitute I will go to jail. I'm confuse, is it in my criminal record or on other type of police record?.

my questions:1- Is there a law about 10000 fine and jail for the gun replica?. 2- the ticket for promoting prostitution is in my criminal record?. 3- Will I go to jail for second time promoting prostitution?

thank you.

Re: Promoting prostitution and gun replica possession

It is impossible to tell what you are charged with without seeing the charging documents. Additionally, charges are often changed by the prosecuting attorney from the officer's recommended charge to something deemed more appropriate based upon further investigation or legal analysis. There are indeed misdemeanors which could potentially apply to either behavior which could carry up to 9 months jail and a $10,000.00 fine. There are also local ordinances which carry a fine only, although jail can result if you fail to pay the fine. Ordinances are not crimes and do not give you a criminal record, although they still become a part of your permanent record both with the local agency and various national criminal data bases, especially if you were photographed and printed. I cannot begin to predict what your sentence might be without further investigation--feel free to send a private e-mail for further follow-up.
