Legal Question in Criminal Law in Wisconsin
I got pulled over for a DUI and got charged with a DUI (2nd) and PAC and no insurance cards, even though the cop saw the insurance cards. I had some marijuana and a pipe in the car, but they didn't say anything at the time. When I left jail I was given paperwork for those charges. I went and looked online to see when court was and the charges and now have a charge for Possession of THC, and possession of drug paraphernalia, but no insurance charge. I'm wondering if they can charge me for that after the fact?

Yes, in WI they can charge you with misdemeanors up to three years after the offense, and changing their mind on the exact charge issued is commonplace, since the DA, rather than the arresting officer, makes the final decision, often quite a few months later. Since you second minor drug offense is a felony in WI, you should defend this one to the full extent available to you. These convictions will also reduce your employability and potentially raise your car insurance rates.
