Legal Question in Criminal Law in Wisconsin
Being questioned by police
I have a twin brother who is in the Army and it just so happens that the day before he left for basic training an old woman was killed that lived down the street (this happened 2 years ago and they are now suspecting him). The Police have taken DNA and a polygraph from him but still continue to question the family and friends. The detectives are being very sneaky and lieing about certain things. They are going to extreme lengths to contact people that are close to my brother including myself when i dont even live in the same city. My parents have set up a meeting with the police at their place of residence in 2 days. Should they have an attorney present?
Again, this happened 2 years ago and they are now questioning him. We have no idea how they got his name but, we figure it is because he is a young man that lived in the neighborhood at the time of the crime. We also believe they might be going after our family name because people in our family have gotten in trouble in the past.

I would always recommend the anybody who is remotely involved in homicide investigation consult with an attorney prior to interrogation by law enforcement. And, in a situation involving DNA evidence, an identical twin of a suspect would likely have DNA which may be indistinguishable from that of the primary suspect, making him also a suspect. Such a person may therefore have interests which conflict with the defendant and should therefore make sure to consult counsel who is not associated with counsel for the defendant.
