Legal Question in Criminal Law in Wisconsin
being read you're right's when arrested
I was placed under arrest for domestic violence. I am a citizen of Canada and permanent resident of the U.S. I had never been arrested in either country before this. Therefore I have three questions. First, when someone is arrested in the U.S., is it mandatory that they be read their rights? Second, if it is , what might my options be if I was not read my rights?( because how would I know what they are being from Canada?) Third, will this effect the outcome of my citizenship hearing when that time comes?

Contrary to popular belief, there is
no requirement that rights ever be read
to an arrested person. It is only
required if the police want to use
a custodial confession against the
defendant in court. Any conviction can
make it harder to become a naturalized
citizen.
