Legal Question in Criminal Law in Wisconsin
I have been recently accused of not reporting $20,000 in income 2 years ago while recieving food share and medicaid for myself, my husband and my 3 children. What is going to happen if i am prosecuted for this? Will i go to jail? probation? Felony? I haven't had any prior convictions for anything. Also i am in the process of getting a divorce, will my husband be held responsible for this too? I don't know how any of this works. I am in the state of Wisconsin.

You are in dire need of the services of an experienced criminal lawyer. Because I do not know exactly what you are charged with, I could not begin to know what you face. Generally, however, whether you will go to prison will depend more upon your prior record than anything else. If your record is clear, a financial crime which does not involve large sums of money is not likely to result in a long prison sentence in most cases, assuming that you "play your cards right." It certainly may be possible for your husband to be charged as well if he was in any way involved or knowledgeable of the fraud. My comments in this online forum are offered for public educational purposes only and are not legal advice, nor do they create any attorney/client relationship between us. Even if I were advising you, the background information which you provided did not include sufficient detail to allow any sort of reliable advice upon which you should rely. Finally, I may be able to represent you if you contact my Racine office and make arrangements formally retain me. I represent clients throughout the state of WI.
