Legal Question in Criminal Law in Wisconsin
I recently was served a search warrent for my home? In the warrant it stated to be served within 48 hours. The warrent was signed on third and I would like to know if weekends are excluded
1 Answer from Attorneys
Time limits for serving search warrants are usually not strictly enforced, but if yours was served late, you might have an issue which your attorney could raise in court to get the evidence suppressed. For time periods of expressed in hours, weekends and holidays are normally excluded, and if the last day falls on one, there is an extension to the next business day.
Do not assume that I am your attorney due to this answer, but you should nonetheless feel free to request clarifications or ask further questions. Otherwise, I would not normally be taking any further action on your case. See me on the web at www.jayknixonlaw.com.
