False Restitution Claim by Victim of Theft
You need to discuss this with your lawyer as soon as possible. In all criminal cases involving restitution, it is possible to have a restitution hearing after sentencing where the judge determines which amount is reasonable. Unfortunately, however, if the testimony of an innocent victim conflicts with that on an admitted thief, the victim's version will usually win out. Consider this part of the price of being a thief--often, the thief is the next one victimized if the victim is unscrupulous. In all criminal matters, if it critical that you be represented by an experienced criminal lawyer at all stages of the proceedings.
