Underage drinking violation in wi

Daughter was cited for an underage drinking violation at Brewer stadium parking lot in Wisconsin. She was holding a red plastic cup that had lemonade in it at the time. She had been drinking alcohol earlier. The officer gave her a citation for possessing alcohol- never ask what was in the cup, never gave her the breathalizer, nor had her empty the cup. Let her walk away with the beverage and citation.

Should she go to court and plead not guilty?

I would always recommend that minors who are charged with under aged drinking go to court and challenge the violation since such convictions can lead to drivers license revocation and much higher car insurance rates. This is true even if the violation does not involve driving. Even if there is no defense, an experienced lawyer can often negotiate and outcome which will look much better on the driving record. Part of any such resolution may be involve substance abuse counseling for the minor which never hurts, even if the drinking problem is not yet severe.
