Legal Question in Criminal Law in Wisconsin

Unlawful use of a telphone

I got charged with unlawful use of a telephone about a yr ago. I never got a ticket it for it or anything like that. I found out through Wisconsin CCAP that I had missed a court date and they issued a warrant. I looked at the address that was listed and it was the wrong address. What is going to happen now? Can I mention that they screwed up and have it dismissed or will that not matter? and What usually happens in these type of cases?

Re: Unlawful use of a telphone

Well, what usually happens in this situation is you will eventually get arrested, unless you turn yourself in. Making sure that they had your correct address was your responsibility, not theirs. So don't be naive or hopeful enough to think that it will get your case dismissed, or that it will even get you any leniency. If anything, it will likely result in a degree of frustration on the part of court personnel and the prosecutors such that it may make things more problematic for you. Go turn yourself in and pay better attention in the future. Good luck.

Re: Unlawful use of a telphone

You should contact a criminal defense attorney who can get in touch with the County Prosecutore and arrange for an initial appearance. Once the initial appearance has been made the warrant will be withdrawn or quashed. What happens with an UUT charge depends onthe nature of the call, the context the call took place in and all of the surrounding circumstances of the players. Assuming there isn't a good defense, typically, absent a long criminal history, a good attorney can achieve a very liveable disposition for you.
