Legal Question in Criminal Law in Wisconsin
warrant in Florida
My son has a warrant in Florida for Grand theft over $300 and less Than $5000. If he is stopped in Wisconsin, would Florida extradite him?

Florida Felony Arrest Warrant, Extradition from WI
There is usually no way to tell if any state will extradite on a warrant until the defendant is in custody. Even, then, he will usually sit in jail in the state of his arrest until the requesting state makes up their mind, which can take months. My advice would always be to retain an attorney in the requesting state and ask him to attempt to work out your son's surrender. Treatment will nearly always be more lenient with voluntary surrender as opposed to extradition, since it shows a desire to cooperate--a necessary part of any rehabilitation plan. There is also sometimes a chance to work out resolution of more minor charges without returning to the requesting state, such as by offering to pay restitution, etc.
