Bail bondsmen are not allowed to operate in WI, meaning that the only recourse for a person who cannot achieve release on bail is to have his or her attorney petition the holding court for modification of his bond. Third parties, such as family members, are sometimes allowed to "co-sign" bonds and are sometimes allowed to pledge property (such as their homes rather than cash) in order to guarantee the defendant's appearance in court and compliance with other terms of bail (such as no drinking or driving). It is also possible for WI courts to totally deny bail to persons deemed to be a sufficiently serious threat to the public, which often includes chronic repeater drunken drivers. A good criminal lawyer, however, can often set up conditions of release (such as release to a rehab facility with electronic monitoring), which will satisfy the judge that the person will not continue to drive drunk while his or her case is pending.
