Legal Question in DUI Law in Wisconsin

drivers license

About 22yrs ago, I was revolked in the state of illinois. for a third offense of dui. I did all they required at that time to reinstate, only I had three years of waiting before I could do that. I waited till 1992. I then had moved to wisconsin. I let wi know what I needed to do for ill. they required that I show proof of my compliance to ill. I did that. I was then issued a valid class D license. kept that for about 1yr. then went to driving school to obtain a cdl. I have had a valid cdl for the past 13yrs, never a problem till aug 2006, then wisconsin informed me that they could not renew. what is my next move? I can't even do my job now and stand to lose my home. Need info soon if you have any. Thanks for your time.

IL Drivers License Reinstatement After DUI-OWI Convition

I would need to see your entire record in order to answer your question. I do know from working with past clients that reinstatement following a DUI/OWI conviction can be a nightmare in IL, and that IL puts a block on many drivers WI privileges due to a failure to comply with court ordered counseling (which can cost many thousands of dollars). My advice would be to hire an IL lawyer if that is where the problem originates. Corruption and mismanagement in the Department of Motor Vehicles is well documented there, including charges against a former governor for selling drivers licenses. I have had clients spend thousands for months of counseling there only to be told that getting the counselors report took too long to obtain, meaning that they had to start all over. WI DOT officials acknowledge this problem but legally have no power to provide relief from it. One big difference between WI and IL is that convictions for DUI are rare in IL on account of their judicial probation system which results in eventual dismissal of the charges for cooperative drivers. On the rare occasions when someone is convicted in IL, they tend to throw the book at them, assuming that their problem with drinking is incorrigible. In WI, on the other hand, nearly all drivers charged with DUI are convicted and are given a clear program for reinstating their license after the court ordered revocation period ends. Unfortunately, however, IL treats WI convictions the same as IL convictions for IL residents, triggering treatment which is often unduly harsh, arbitrary and capricious. You might be able to fight them on the latter grounds if you can afford it.
