Drug and Alcohol Assessment and Required Treatment in Order to Reinstate License When Violation Occurred Out of State

Traditionally, following an OWI conviction, courts in WI refer the defendant to the approved agency in the county of conviction for the mandatory drug and alcohol assessment. That agency then decides where the follow-up treatment or classes should occur--often in the defendant's home county. Exceptions can occur, for example, in cases where the defendant is deemed to be an alcoholic. In such grave situations, they may order inpatient detox./rehabilitation in any facility deemed appropriate, regardless of its location. You should speak with an IL attorney for advice on this point, but my guess is that IL's procedure is more or less similar to WI--referral back to the home county for treatment following an initial assessment in the county of conviction. However, I have had clients who experienced unpredictable results in complying with their OWI assesments in the IL justice system; hardly a shock considering that their former Governor Ryan just entered Oxford Federal Prison in WI following his corruption conviction for official corruption including the illegal sale of driver's licenses to ineligible persons. The history of official corruption in IL is nearly legendary, so one is nearly always better off consulting with a local lawyer with extensive experience in dealing with their "system" there.
