Adjournment of DUI and Hit and Run
Only the judge or his staff (acting with his authority) can adjourn a case, but will not do so unless the prosecutor also consents to the adjournment. The hit and run charge is usually a criminal matter in WI (as is a 2nd and subsequent DUI). Therefore, if you do not appear as scheduled, a warrant for your arrest will generally be issued. For non-criminal traffic cases, however, a default judgment of conviction will be taken against you if you do not appear. If your conflicting business is truly urgent, your attorney should have no trouble getting a new initial appearance date for you as long as you give him enough lead time (usually several weeks).
