Drunk Driving First Offense Occupational License
You should be able to get an occupational license immediately after you are administratively revoked by the DOT, unless you are also accused of refusing a chemical test, have multiple offenses, or have a previous revocation within the last six months. The DOT administrative revocation will normally be start 30 days after the date you were arrested (or the date the blood test results come in, if later), and does not involve the courts. Hence, your court date is often not all that important in determining the date when you can get your occupational license, unless it is less than 30 days after the arrest(rare in most WI courts). Once you are sentenced and the judge revokes you again, you must make sure that he does not revoke your occupational license if you get one beforehand. Generally, in order to get an occupational license, you must have special "SR-22" insurance which covers you in all vehicles, owned or non-owned, and you normally must have completed your drug and alcohol assessment. All of this is more complex for subsequent offenses or refusals. If you want to save your license from either an administrative suspension or a refusal revocation, it is critical for you to get a lawyer as soon a possible to challenge these suspensions by requesting a hearing. This request must be made less than 10 days after you were arrested, or all rights to fight this punishment are waived. Another thing to remember, even on first offense, is that you will never be able to reinstate your license for the rest of your life until you complete your drug and alcohol assessment and follow through on all treatment recommendations. Good luck!
