Occupational License Following Second Offense Drunk Driving Conviction

Depending upon whether or not a person consented to an alcohol test and cooperated with the officers, an occupational license is still a possibility for a second offender. However, there are waiting periods before the occupational license can be issued for some repeat offenders. Of course, in order to get an occupational license, one must be otherwise be eligible for reinstatement (but for the new OWI sentence). This means no revocations due to unpaid fines, demerit points, Habitual Traffic Offender findings, etc. One also needs to have insurance of the SR-22 variety (which covers both owned and non-owned vehicles), and no previous revocations within a six month period other than for the present offense. Judges sometimes have the power to "overrule" the DOT in certain scenarios where the DOT will not issue the occupational.
